محیط‌زیست یکی از مصادیق حقوق بشر بوده و دادستان به عنوان حافظ حقوق‌عامه در نظارت بر حفاظت از محیط‌زیست و اقدامات لازم در پیشگیری از تخریب آن و اعلام جرم و تعقیب تخریب کنندگان و مجرمان زیست محیطی وظیفه‌ی خطیری را عهده‌دار است. در خصوص پیشگیری از تخریب محیط‌زیست، دادسرا نقش اصلی را ایفاء می‌نمایند؛ دادسرا با صدور دستورات‌ویژه در خصوص پیشگیری از آلودگی و تخریب محیط‌زیست مانند تعطیلی صنایع آلوده‌ساز یا الزام آنها به اصلاح ماشین‌آلات مربوطه، آموزش و نظارت بر اقدامات ضابطین حوزه‌ی‌محیط‌زیست و نیز رسیدگی فوری و صدور احکام قاطع در دعاوی زیست‌محیطی در دادگاه‌ها و برخورد جدی با متعرضین به محیط‌زیست، نشان می‌دهد که قوه‌قضائیه در برخورد با تخریب و ارتکاب جرایم زیست‌محیطی هیچگونه تساهل و تسامحی نخواهند‌داشت. این امر اثر ارعابی و پیشگیرانه در وقوع مجدد این جرایم داشته‌باشد، اجرای اشد مجازات برای مجرمان زیست محیطی و اعمال جریمه‌های مالی سنگین و الزام آنان به اعاده‌ی وضع به سابق نیز ریسک ارتکاب جرایم را برای مجرمان بالا برده و درصد میزان جبران خسارات زیست محیطی را افزایش می‌دهد. . در این مقاله با روش توصیفی-تحلیلی و با تکیه بر تحلیل محتوایی و اصول‌حقوقی چالشهای حفظ محیط‌زیست از منظر صلاحیت دادستان بررسی و کنکاش می‌گردد. |

The environment is one of the instances of human rights and the prosecutor, as the guardian of public rights, has a serious duty in overseeing the protection of the environment and the necessary measures to prevent its destruction and to declare crime and prosecute environmental destroyers and criminals. In preventing environmental degradation, the prosecutor's office plays a key role. The prosecutor's office issues special orders to prevent pollution and environmental degradation, such as shutting down polluting industries or requiring them to repair relevant machinery, training and supervising the actions of environmental officers, as well as prompt consideration and final rulings in environmental lawsuits. The environment shows that the judiciary will have no tolerance for the destruction and commission of environmental crimes. This has a frightening and preventive effect on the recurrence of these crimes, the implementation of severe punishment for environmental offenders and the imposition of heavy financial penalties and their obligation to restore the status quo also increase the risk of crimes for offenders and increase the percentage of environmental compensation. Increasing. In this article, descriptive-analytical method and relying on content analysis and legal principles, the challenges of environmental protection from the perspective of the prosecutor's competence are examined and explored. |
